These Terms of Service (“Terms”) govern your access to and use of the Mirock Toolworks website (the “Site”) and any purchases made through the Site. By using the Site or placing an order, you agree to these Terms.

If you do not agree, do not use the Site.

Disclaimer

This store is integrated with the Western Bid™ e-commerce platform, and Western Bid, Inc. is the Merchant of Record for all purchases made in this store. Therefore, you will see “WESTERN BID” listed as the payee on your PayPal account and credit card statement.


1) Definitions

  • “Mirock Toolworks,” “we,” “us,” “our”: the seller operating the Site from Dnipro, Ukraine.

  • “you,” “your,” “customer”: any person using the Site or purchasing products.

  • “Products”: goods offered for sale on the Site, including made-to-order or customized items.


2) Eligibility

You must be legally able to enter into a binding contract in your jurisdiction to use the Site and place orders.


3) Products, handmade variations, and availability

  • Products may be handmade or produced in small batches. Natural variation in materials (e.g., wood grain, patina, minor tool marks) can occur and is not considered a defect.

  • Photos are illustrative. Lighting and screens can affect color appearance.

  • Product availability can change without notice.


4) Pricing, currency, and taxes/duties

  • Prices are shown on the Site and may be updated at any time. The price charged is the price shown at checkout.

  • You are responsible for any import-related charges that may apply in your country (e.g., VAT, duties, brokerage fees), unless explicitly stated otherwise at checkout.

  • If a pricing error occurs, we may cancel the order and refund you.


5) Orders and acceptance

  • Placing an order is an offer to buy. We may accept or reject any order (for example, due to stock limits, payment issues, suspected fraud, or shipping restrictions).

  • The order is accepted when we confirm it and/or ship it, depending on the workflow used on the Site.


6) Payment

You agree to provide current, complete, and accurate payment and order information. We may cancel an order if payment cannot be verified or processed.


7) Manufacturing / processing time

Some items may require production/processing time before shipment. Any stated lead time is an estimate and can vary due to workload, materials, or operational constraints.


8) Shipping, delivery, and risk of loss

  • Shipping methods, costs, and estimated delivery windows are shown at checkout or in the shipping policy on the Site. Delivery dates are estimates.

  • Once the package is handed to the carrier, delivery delays caused by the carrier, customs, weather, or local conditions are outside our control.

  • Risk of loss generally passes to you upon delivery to the carrier, unless your local consumer law requires otherwise.


9) Incorrect address, failed delivery, and returns-to-sender

  • You are responsible for providing a correct and complete shipping address.

  • If a package is returned due to an incorrect address, refusal, or failure to collect, we may require you to pay re-shipping costs. If re-shipping is not possible, we may refund the product price minus shipping/handling and any return fees charged by the carrier.


10) Returns, refunds, and exchanges

Return rules depend on whether the item is standard or custom/personalized.

10.1 Standard (non-custom) items

  • Returns may be accepted within 14 days of delivery if the item is unused and returned in original condition/packaging (reasonable inspection allowed).

  • You are responsible for return shipping unless we confirm the item is defective or we shipped the wrong item.

  • Refunds are issued to the original payment method after inspection.

10.2 Custom, personalized, or made-to-order items

  • Custom/personalized/made-to-order items are generally not refundable unless defective or incorrect (for example, wrong customization compared to what you approved/ordered).

  • If a return is authorized, instructions will be provided by email.

10.3 Damaged, defective, or wrong item

Contact us at mirock1979@gmail.com within 7 days of delivery and include:

  • order number,

  • photos of the issue and packaging,

  • a short description.

We will offer a reasonable remedy: replacement, repair, partial refund, or full refund, depending on the situation.


11) Cancellations

  • If production or fulfillment has not started, we may be able to cancel and refund your order.

  • If the item is already in production, customized, or shipped, cancellation may not be possible or may involve costs.


12) Product safety and use

You agree to use products responsibly and in accordance with any instructions or warnings provided. Sharp tools and metal components may pose injury risks if misused.


13) Intellectual property

All Site content (text, images, logos, product designs, photos, and branding) is owned by or licensed to Mirock Toolworks and may not be used without written permission, except as allowed by law.


14) User content and feedback

If you submit reviews, comments, or media, you grant us a non-exclusive right to use it for operating and marketing the Site, unless prohibited by law. You are responsible for ensuring your content does not violate third-party rights.


15) Prohibited use

You agree not to:

  • violate any laws,

  • attempt to access systems without authorization,

  • introduce malware,

  • scrape/harvest data without permission,

  • interfere with Site functionality.


16) Disclaimer of warranties

To the maximum extent permitted by law:

  • The Site and products are provided “as is” and “as available,” except where specific warranties are required by applicable law.

  • We do not guarantee uninterrupted Site access or that the Site will be error-free.

Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.


17) Limitation of liability

To the maximum extent permitted by law:

  • Mirock Toolworks will not be liable for indirect, incidental, special, consequential, or punitive damages.

  • Our total liability for any claim relating to an order will not exceed the amount you paid for the product(s) giving rise to the claim.

Nothing in these Terms limits liability where it cannot be limited under applicable law.


18) Indemnification

You agree to indemnify and hold Mirock Toolworks harmless from claims arising out of your misuse of the Site, violation of these Terms, or violation of any law or third-party rights.


19) Governing law

These Terms are governed by the laws of Ukraine, without regard to conflict-of-law principles.


20) Dispute resolution

Before filing a formal claim, you agree to contact us at mirock1979@gmail.com to attempt to resolve the issue informally. If unresolved, disputes may be handled in courts with appropriate jurisdiction under Ukrainian law, unless mandatory consumer protections in your country require otherwise.


21) Changes to these Terms

We may update these Terms from time to time. The updated version is effective when posted with a new effective date. Continued use of the Site after changes means you accept the updated Terms.
